Terms and Conditions of Sale (T&Cs)

2. Scope and Acceptance

These Terms & Conditions apply to all sales made via www.thehobbiesgate.fr to consumers. Placing an order constitutes full and unconditional acceptance of these T&Cs in force at the time of purchase (available on the website and sent by email with every order confirmation).

3. Products

Product features (description, compatibility, non-contractual photos, user guides where necessary) are found on each product page. Products are compliant with French law. Customers are responsible for compatibility and correct use.

4. Customer Account and Security

Ordering requires creating a customer account (personal login and password). Customers must keep credentials confidential and immediately report any fraudulent use.

5. Ordering, Modifications & Cancellations

  • Order: Orders are confirmed with a double-click (“double confirmation”), basket review, acceptance of T&Cs, and secure payment. Confirmation is emailed with the invoice.
  • Modifications/Cancellations:
    • The customer may modify or cancel the order as long as it has not been processed and prepared.
    • For item removal before order preparation, refunds are made via the original payment method or as a store credit at the customer’s choice.
    • If the order has already shipped or been passed to the carrier, a return request must go through the customer account; return shipping is at the customer’s expense. Refunds occur after goods are received and inspected.

    Return shipping costs are the customer’s responsibility.

The company reserves the right to reject any order for legitimate reasons (dispute, abuse, incomplete or incorrect information, etc.).

6. Prices & Payment

Product prices are displayed as follows:

  • Euros (incl. VAT) for customers in the European Union.
  • Euros (excl. VAT) for customers in French overseas territories*.
  • Swiss francs (excl. VAT) for customers in Switzerland.
  • Pound Sterling (GBP) for UK customers, in keeping with VAT legislation.

For UK customers:

  • Orders up to and including £135: UK VAT is collected and invoiced at checkout (GBP, VAT included).
  • Orders over £135: Orders are invoiced exclusive of tax; all VAT and import charges must be paid by the customer on UK entry (to the carrier or HMRC).

*For French overseas territories (Guadeloupe, Martinique, French Guiana, Réunion, Mayotte, French Polynesia, New Caledonia, Wallis & Futuna, French Southern & Antarctic Lands, Saint Pierre & Miquelon, Saint Barthélemy, Saint Martin), orders are issued ex-VAT; VAT/duties are payable by the customer on delivery. Prices displayed before identifying the customer may change depending on the delivery address. The total price, including any additional charges, is confirmed before order validation. Orders are final only after successful payment. Orders are cancelled if payment fails.

7. Delivery & Lead Times

  • In-stock products:
    • Orders placed before 15:45 (business days) ship the same day.
    • Colissimo/Chronopost: handed to the carrier in the evening.
    • Mondial Relay: deposited at relay point/locker the same day; shipping by Mondial Relay commences next morning.
  • Backorder items:
    • Delivered within 14 days maximum.
    • If unavailable after 5 working days, the customer will be notified and may request a refund.
    • If the agreed 14 days is exceeded, an automatic refund is issued within 48h.
    • Backordered or spare parts may be shipped separately, possibly via tracked letter.

Upon receipt, the customer must inspect the parcel and report any irregularities to customer service within 48h, noting issues with the carrier if applicable.

Shipping to non-EU/overseas territories: Orders going to French overseas territories and non-EU countries may incur additional shipping charges due to volumetric weight or specific shipping conditions. The Hobbies Gate will notify the customer before dispatch. The order will only ship once these additional fees are accepted and paid by the customer, who explicitly agrees to pay these fees when required.

8. Right of Withdrawal

Customers benefit from a 14-day legal withdrawal (cooling-off) right from receipt of goods (except where excluded by law). Items must be returned complete, clean, and unused. Refund within 14 days of receipt or proof of dispatch. Return shipping is at the customer’s expense:

9. Warranty & After-Sales Policy

All goods are covered by French statutory warranties:
Conformity Warranty (2 years): repair, replacement or refund as per the law.
Latent Defect Warranty (2 years from discovery): return/refund or price reduction as appropriate.
Application of these warranties may require a product return/inspection.

Warranty Exclusions:

  • Damage from incorrect assembly, handling or misuse by the customer
  • Intentional or accidental breakage
  • Reverse polarity to any electronic component (ESC, motors, transmitters, receivers, chargers, etc.)
  • Damage due to damp, moisture (water ingress), or internal corrosion
  • Use not compliant with product instructions or required technical guidelines

SAV/After-sales service procedure: All claims must go through our dedicated SAV request form. For incomplete kits or missing/defective parts, the same process applies.
No after-sales request will be handled via Facebook, Messenger, phone, or without at least one photo of the faulty component.

SAV Returns – Costs & Storage:
If in doubt over the validity of a claim, the customer covers shipping to our address.

If a defect is confirmed, shipping costs are reimbursed as store credit.
If no fault is found, the customer must pay return postage prior to return shipment.
In the event return postage is not paid within 12 months of notification (email/letter), the item is considered abandoned. After written notice, The Hobbies Gate may dispose of the item in accordance with French law (Article L.221-15 French Consumer Code).

Warranty/after-sales for reseller purchases: As direct importer for certain RC brands, The Hobbies Gate only handles after-sales/warranty claims for its direct (retail/professional) customers. Claims for goods bought via a stockist must be directed to that retailer.

10. Customer Service & Dispute Resolution

If a dispute cannot be resolved, customers may contact the District Court of Vesoul (+33 (0)3 84 68 68 20), or register the case via the European ODR platform (ec.europa.eu/consumers/odr).

11. Intellectual Property

All content on this site (texts, images, logos, databases, etc.) is protected. Any copying, distribution or exploitation is strictly forbidden without prior written consent.

12. Personal Data / Privacy

KZL Marketing is committed to confidentiality and secure processing of personal data, under GDPR.
Data is collected strictly as needed (order management, shipping, billing, marketing with consent).
Retention is as per legal requirements.

13. External Links

The website may contain links to third-party sites. The Hobbies Gate is not responsible for their content or use.

14. Customer Conduct – Right to Refuse

The Hobbies Gate may refuse or suspend business with any customer who:
– is disrespectful;
– abuses return rights;
– posts unjustified criticism regarding The Hobbies Gate (on social networks, the internet, in public or private);
– applies undue pressure regarding support, warranty or delivery while statutory deadlines have not lapsed.

15. Changes to the T&Cs

These T&Cs may change at any time. Only those valid at the time of order apply to that order.

16. Governing Law

T&Cs are governed by French law.

17. Acceptance

The customer confirms having read and accepted these T&Cs before placing any order.
